That lever is the magazine cutoff. It will prevent the carrier from feeding cartridges, holding the magazine in reserve. In that setting, the rifle is fired as a single shot, loading cartridges individually. A flip of the lever allows the rifle to be fired as a repeater with each cycle of the bolt.

Flayderman mentions the Model 1898, serial no. 152670 as the cutoff between antique and modern, by federal law. Does this match what your letter from ATF states?
